Alabama and Texas A&M Kickoff Time Set for 6:15 p.m. on ESPN

TUSCALOOSA, Ala. – Alabama’s game against the Texas A&M Aggies in College Station, Texas on Saturday, Oct. 7 is scheduled for a 6:15 p.m. CT kickoff on ESPN the SEC office announced Monday.

Alabama and Texas A&M will meet for the 10th time in a series that dates back to 1942. The Crimson Tide leads the all-time series, 7-2, including a 3-0 record at Kyle Field. Alabama won last year’s meeting, 33-14, at Bryant-Denny Stadium and is 4-1 against the Aggies since Texas A&M joined the Southeastern Conference in 2012.

Tony Riley Announces State House Candidacy

Tony Riley Candidate for  State Representative

 

Attorney Tony Riley will run for the Republican nomination for the District 18 seat for the Alabama House of Representatives.

District 18 includes Franklin, Colbert, and Lauderdale counties. Rep. Johnny Mack Morrow (D) – Red Bay, who has held the seat since 1990, has announced his intentions to run for higher office.

Riley has served as Human Resources Director and General Counsel at nationally known Tiffin Motorhomes for 10 years and previously practiced law in Colbert County for 18 years.

The Riley campaign will focus on economic growth in Northwest Alabama and improving education.

“With the unprecedented economic growth that parts of Alabama have experienced over the past few years, it is now more important than ever that we, in the more rural areas of the state, concentrate on improving education. This must be our goal so that our children have the advantage for opportunity, success, and the ability to stay and thrive in their hometown.”

Riley has a Bachelor’s degree and a Juris Doctorate from the University of Alabama. He has been actively involved with Republican politics for over three decades.

Moore’s win a direct rebuke of Mitch McConnell

WASHINGTON, DC– Tuesday night, Republican political strategist Jordan Gehrke released a memo detailing how Roy Moore’s victory last night in Alabama’s Senate race was a direct rebuke of Mitch McConnell and the DC Swamp.

Gehrke states, “Roy Moore did not win despite McConnell’s opposition, he won because of McConnell’s opposition. Going all the way back to the Primary, both Roy Moore and Mo Brooks promised that if elected, they would not support McConnell for Leader under any circumstances. They won because of open defiance to the Majority Leader. This is simply unprecedented.”

Moore carried Lauderdale and Colbert counties to win the run-off on Tuesday. The Shoals Insider carried Judge Moore’s recent visit to Florence live on Facebook.

Moore told the Insider, “I am not praying to win. I’m just praying the Lord’s will be done,”

Brooks calls for end of taxpayer funding of sports leagues that disrespect our flag and national anthem

WASHINGTON, D.C. – Congressman Mo Brooks (AL-05) today drafted a letter urging President Donald J. Trump to honor the American flag and anthem by stopping all Department of Defense and federal government support for professional sporting leagues or teams that display disrespect for our flag and national anthem. Brooks circulated the letter to House colleagues for support.
In the letter, Congressman Brooks stated, “Federal law about the American flag and national anthem is clear. 4 U.S.C. § 8 states, ‘the flag represents a living country and is itself considered a living thing’ and adds that ‘no disrespect should be shown to the flag.’ Further, 36 U.S.C. § 301 states, ‘During rendition of the national anthem when the flag is displayed, all persons present should face the flag and stand at attention with their right hand over the heart.’ The National Football League (NFL) is disrespecting America’s flag and national anthem. The NFL’s conduct is not only unpatriotic and deplorable, it also conflicts with federal law.”

Brooks continued, “The foregoing considered, we respectfully ask that you withhold all federal taxpayer dollars that directly or indirectly support (via advertisements, marketing contracts, or any other direct or indirect financial patronage) any professional sports team or league that refuses to display proper decorum for America’s flag or national anthem.”

Dear President Trump:

Federal law about the American flag and national anthem is clear. 4 U.S.C. § 8 states, “the flag represents a living country and is itself considered a living thing” and adds that “no disrespect should be shown to the flag.” Further, 36 U.S.C. § 301 states, “During rendition of the national anthem when the flag is displayed, all persons present should face the flag and stand at attention with their right hand over the heart.”

The United States flag and our national anthem are emblems of a nation that has arguably been the most free, wealthiest, most militarily powerful, and greatest nation in world history. As such, Ronald Reagan stated:
As we think back over the history of our nation’s flag, we remember that the story of its early years was often one of hardship and trials, sometimes a fight for simple survival… As the American Republic grew and prospered and new stars were added to the flag, the ideal of freedom grew and prospered. From the rolling hills of Kentucky to the shores of California to the Sea of Tranquility on the Moon, our pioneers carried our flag before them, a symbol of the indomitable spirit of a free people. And let us never forget that in honoring our flag, we honor the American men and women who have courageously fought and died for it over the last 200 years, patriots who set an ideal above any consideration of self. Our flag flies free today because of their sacrifice.

The National Football League (NFL) is disrespecting America’s flag and national anthem. The NFL’s conduct is not only unpatriotic and deplorable, it also conflicts with federal law.

In FY2017, the Department of Defense (DOD) is estimated to spend $574 million on military service component advertising programs. [1] Total federal spending on advertising and public relations is roughly $1 billion per year. [2]

We see no reason why federal taxpayers should spend any money, directly or indirectly, supporting professional sports teams or leagues that disrespect America’s flag or anthem.

The foregoing considered, we respectfully ask that you withhold all federal taxpayer dollars that directly or indirectly support (via advertisements, marketing contracts, or any other direct or indirect financial patronage) any professional sports team or league that refuses to display proper decorum for America’s flag or national anthem.

More specifically, we ask that the federal government cease advertising (television, radio or otherwise) on any network or in any media during that network or media’s broadcast of any sporting event by a professional sports league or team that engages in the above disrespectful conduct that insults America and those who have fought or given their lives for our country.

The NFL and its players and teams assert they have a First Amendment Freedom of Speech right to disrespect America’s flag and national anthem contrary to federal law. Perhaps. But American taxpayers certainly have the right to stop their hard-earned tax dollars being used to support disrespect for America’s flag and national anthem.

We join in asking you to stand and honor the American flag and anthem by stopping all DOD and federal government support for professional sporting leagues or teams that display disrespect for our flag and national anthem.

Killen shooting under investigation

KILLEN–The Shoals Insider has confirmed one person was shot Tuesday night in Killen.

Police say the shooting incident occurred on North Forest Drive, on the outskirts of Killen.

Authorities tell the Insider that the suspect is still at large.

The male victim was shot in the back once.

Emergency personnel say the victim was taken to a local hospital.

The investigation is ongoing and more details will be released as they become available.

MUSCLE SHOALS–Recently, JASA held their 28th Annual Dinner in Birmingham, Alabama. During the event North American Lighting (NAL), a tier one supplier of automotive lighting systems located in Muscle Shoals, was honored with this year’s Certificate of Achievement Award for their past success and continued growth in the Shoals.

The Japan-America Society of Alabama (JASA) is a private, not-for-profit association working toward encouraging and developing friendship and understanding between individuals within the communities of Japan and the United States. Through programs responsive to social, economic, and political needs, Alabamians are afforded the opportunity to examine and learn from experiences and achievements of both nations.

In 2006, NAL broke ground on a 250,000-square foot facility in the Shoals Research Airpark with plans of hiring 400 employees. Additional expansions to the facility were completed in 2010, 2011, and 2013, resulting in a 600,000-square foot facility with over 1700 employees. NAL is currently the largest manufacturing employer in the Shoals.

Police investigate shooting next to Tuscumbia restaurant

TUSCUMBIA–Police are on the scene of a shooting on HWY 72 next to Two Fat Sisters restaurant. Authorities are still investigating the incident where one woman was shot.

One person has been detained according to authorities.

The home is across from Shoals Outdoor Sports.

There’s plenty to do this weekend in the Shoals Area.

You don’t want to miss  “A Day with Rey” It runs Friday and Saturday, Sept. 28-Sept 30, at 7:30 pm and on Sunday, Oct 1, at 2 pm.

The original production “A Day with Rey,” written by Jesse Sockwell and directed by Brandon Willcutt.

It stars Jesse Sockwell, Harmony Malone, Joy Ragland, Melanie Dickens and Gabriel Goodloe.

Tickets are $12 and available online at www.historiczodiacplayhouse.com or at the door.

The play brings real issues that people in life go through today and puts them on the stage in a realistic setting.

The Zodiac Playhouse is located at 416 North Court Street in Florence.

Also, this Saturday at McFarland Park is the Shoals Dragon Boat Festival. I posted a video below for those who want to see what it’s like.

It’s neat to watch all the work that goes into the annual effort.  All proceeds go to Kilby Laboratory School. It kicks off at 9:00 am Saturday.

On a more serious note, the 2nd Annual Blue Light Vigil is Saturday night from 7:00 until 11:00.  The event honors our fallen heroes in Blue.

The event will be at the Cowboy Church of Colbert County located at 3440 Highway 157, Leighton.

There will be a ringing of the toll. Guest speakers such as Colbert County Sheriff Frank Williamson, Lawrence County Sheriff Gene Mitchell, Tuscumbia Chief Tony Logan and more are scheduled to speak.

Retired Officer Bobby V. Inman is also scheduled to speak.

At dark, the Officers will turn on their blue lights during the calling of the fallen Heros.

Hats off to the event organizer Amanda Skipworth for her work putting the vigil and speakers together.

The Velcro Pygmies will play at the FloBama, 311 N. Court Street, in Florence Friday night at 9:oo until midnight.

I can’t wait to see these guys jam out. These old boys really know how to put on a show. If you haven’t seen them perform, here’s your chance.

Colbert County Tourism Office Announces Release of New Audio Driving Tour of Shoals

TUSCUMBIA, Ala.  –   The Colbert County Tourism Office is delighted to announce the release of a unique, audio driving tour to assist visitors and music fans in navigating local attractions with the help of an audio guide titled, “We Rocked the World” Muscle Shoals Music.

This audio guide is in a CD format and was produced in conjunction with Tony Raine, a founder of Sounds of the Shoals.  Raine has been a frequent visitor to the Shoals since 2007 and is now a resident.

The project was co-produced and funded by the Colbert County Tourism and Convention Bureau, which is led by President and CEO Susann Hamlin.

 

“This guided driving tour, written specifically for visiting music fans from around the world, primarily those who fly or drive into our area,”  Hamlin said.  “Following the release of the documentary on Muscle Shoals, more and more people, who were coming to our area to connect with the music, had asked us for a tour guide.  This audio tour plus our comprehensive “We Rocked the World” music brochure has been a huge help in moving people throughout the entire area to see our music attractions.”

The tour begins at the Alabama Music Hall of Fame and guides visitors to the recording studios and music sites in Muscle Shoals, Sheffield and Tuscumbia and to other attractions.  The content includes local history and provides an informative narrative about the renowned musicians, events and recordings.

Raine said, “As a first time visitor to the area in 2007, I toured the Alabama Music Hall of Fame and enjoyed the wealth of information and the exhibits.  However, upon leaving the Hall of Fame, I was lost when I tried to navigate the area and look for the other sites.”  Raine, originally from England, is a veteran of the music industry and has been involved in similar projects.

The Muscle Shoals Self-Driving Audio Tour is narrated by local radio personality Marie Tomlinson Lewey and features an introduction by local music legend Travis Wammack with background music by Billy Lawson and Will McFarlane.

The scenic self-driving tour takes the visitor around the county and recommends stops at all local attractions and features a bonus chapter with directions and information on Red Bay, including the Red Bay Museum, Tiffin Motor Homes, and other, outlying locales.

 

The audio guide will also be released online and a mobile phone app is in development. You may purchase a CD copy at the tourism office, 719 U.S. Highway 72 W., Tuscumbia, AL 35674 or at any of the studios and the Hall of Fame in Tuscumbia.  The cost for the CD is $10.

Notice that in Mark 16:17, the Lord promised that (supernatural) signs will accompany believing onesBECAUSE JESUS WILL BE WITH US BELIEVING ONES until the very end of the age (Matthew 28:20). Notice as well that those signs are to accompany believersnot only the original twelve apostles. That promise does away with the modern teaching that miracles were designed to be limited to the early days of the church, and even then to Christ’s original twelve trainees. Several New Covenant passages demolish that theology, for we read in the book of Acts that two DEACONSStephen and Philip—Acts 6:8 and 8:6—did miraclesPaul and Barnabas both performed miracles (Acts 14:3), although they were not of those original twelve. But, to clinch that truth, we need a number of Bible passages, not indirect observation, or theological speculation. Christ said in Luke 6:40 that the disciple is not above his Teacher (Jesus), but the one who is perfectly trained will be like his Teacher. That qualifies more than the original twelve for miracle-ministry. John 14:12 also hits that proverbial nail right on the head: “Truly, truly, I say to you, He who believes on Me will do the same works I do; and greater works than these will he do; because I am going to My Father [to send back the Holy Spirit to help the believer do the same miracles I did].” 

     Still another Scripture portion backing that Bible Truth is Acts 2:33, 38-39. Peter, in explaining what the temple crowd heard and saw when the Holy Spirit descended on the Day of Pentecost, assured the crowd that the Holy Spirit, Who had caused those sounds and sights, was a gift from God to them as well. Thus, when 3,000 of the hearers were baptized on that day, they surely had the same Holy-Spirit-experience as the 120, who had received the gift earlier (supernatural languages). Next time, more Bible promises and commands to the church; all of which enable believers to solve many of the modern world’s painful problems.

58 Dead, Hundreds injured in Las Vegas Shooting

Pharmacy Owner Charged with $10 Million Health Care Fraud

BIRMINGHAM – Federal prosecutors today charged the owner of a Decatur compounding pharmacy with conspiracy to defraud a federal health insurance program out of more than $10 million. U.S. Attorney Jay E. Town, Food and Drug Administration, Office of Criminal Investigation, Miami Field Office, Special Agent in Charge Justin Green and Defense Criminal Investigative Service Special Agent in Charge John F. Khin announced the charge.

The U.S. Attorney’s Office charged JOHN CHRISTOPHER LEMLEY, 51, of Decatur, with the conspiracy and seeks to have him forfeit nearly $1 million as proceeds of the fraud. Most of that amount already has been seized from bank accounts held by Lemley or his businesses, according to the charges.
In conjunction with the one-count information filed in U.S. District Court, prosecutors also filed a plea agreement with Lemley. As part of that agreement, Lemley agrees to forfeit $918,234, along with a 2015 Lexus Gx-460 Premium purchased with criminal proceeds. Lemley must appear before a judge to formally enter a guilty plea.
“This defendant took part in a conspiracy that employed improper contracts, kickbacks, mislabeled drugs and prescription forgeries in order to bilk millions of dollars from the federal health insurance program meant for America’s military members and their families,” Town said. “The FDA and DCIS did a tremendous job uncovering this fraud and our office remains committed to prosecuting every single one of these types of cases.”
“American consumers rely on FDA to ensure that their drugs are safe, effective and properly labeled,” Green said. “Today’s announcement should serve as a reminder of our continued focus on those who put profits ahead of the U.S. public health by distributing misbranded products.”
“In concert with our investigative partners, DCIS aggressively pursues fraud and corruption that undermines the integrity of Department of Defense programs, especially those involving the well-being of our Warfighters who deserve the best medical care available,” Khin said. “It is unconscionable for a health care provider to make profits by taking advantage of military members and their families when they are most vulnerable.”
Lemley owned a Decatur pharmacy that operated as Southern Compounding. He also owned Apotheca Supply, which was licensed to relabel and repackage pharmaceutical drugs and was located in a suite that adjoined Southern Compounding on U.S. Highway 31 South. Lemley also had a 20 percent membership interest in Medworx Sunflower LLC, an affiliate of Medworx Compounding, a compounding pharmacy in Ridgeland, Miss., according to the information and plea agreement.
Between February 2015 to January 2016, Lemley conspired with others at Medworx Sunflower and Southern Compounding to defraud TRICARE, a U.S. Department of Defense health care program, and third-party prescription-drug program administrators Express Scripts Incorporated and OptumRx Inc., according to the court documents.
Southern Compounding submitted prescription reimbursement claims to TRICARE as part of ESI’s pharmacy network. The pharmacy submitted claims to various insurance plans as part of OptumRx’s pharmacy network.
As part of the conspiracy, Lemley conducted the fraud by various means that included improperly contracting with Medworx Compounding to refer prescriptions to Southern Compounding, paying kickbacks to independent sales representatives as incentive to refer TRICARE prescriptions, selling misbranded over-the-counter medications as prescription drugs and not reversing claims on prescriptions Lemley knew were forged, according to the court documents.
Although ESI’s regulations prohibited Southern Compounding from subcontracting any of its work, Southern entered a management agreement with Medworx in early 2015 whereby Medworx referred prescriptions to Southern Compounding, according to Lemley’s plea agreement. Southern filled the prescriptions, billed third-party administrators for them and sent almost all the payments received to Medworx. Medworx then returned a portion of those payments directly to Lemley, the plea agreement says. The amount returned totaled $918,234, representing a distribution for Lemley’s 20 percent membership interest in Medworx Sunflower.
Southern Compounding’s billings to TRICARE soared in the two months after Southern entered its agreement with Medworx, according to the plea agreement. In the 13 months prior to the agreement, TRICARE paid claims of about $215,561 to Southern. In the two months following the February 2015 agreement, TRICARE, through ESI, paid about $10.5 million in claims to Southern, according to the plea agreement. More than 90 percent of that was profit.
In accordance with Southern’s management agreement with Medworx, Lemley transferred most of the money – about $10.2 million – to Medworx. Most of the transferred money was to fund kickbacks to the independent sales representatives, according to the plea agreement.
Lemley faces a maximum sentence of 5 years in prison.
FDA-OCI and DCIS investigated the case, which Assistant U.S. Attorney Chinelo Dike-Minor is prosecuting.

Popular Tuscumbia steak house closes

TUSCUMBIA–OhBryans Steakhouse in Downtown Tuscumbia has called it quits. Sunday, October 1st was the last day the popular restaurant was open for business.

Owners Greg and Lisa Pace could not be reached for comment but family members tell the Shoals Insider they are selling this business at 200 Main Street and will soon be opening a restaurant in Courtland, Alabama.

The restaurant’s Facebook page states, “After 5 years, we made the tough decision to close the doors at OH BRYANS DOWNTOWN. We have been blessed a thousand times more than we deserve. We would like to thank all our wonderful customers, all the great friendships that have been formed. We appreciate all your support and prayers over the last years . We ask that God continues to bless each one of you and your families. Thanks for all the good times. Prayers are appreciated.”

The building’s owner Robbins Property Development tells the Insider other people have expressed interest in the property.

PoBoys Cajun Restaurant, one block North on Main Street recently closed due to one of the owners’ health.

Robert Posey appointed to management position in US Attorney’s office

BIRMINGHAM – U.S. Attorney Jay E. Town has named veteran federal prosecutor Robert O. Posey as executive assistant U.S. attorney for the Northern District of Alabama.

“Robert Posey is an institution of knowledge. His leadership is proven and battle-tested and the Northern District has been fortunate to have it for many years, and it is my hope we will have it for many years to come,” Town said. “Robert will remain a big part of the management team as our new executive assistant U.S. attorney.”

Posey most recently served as the acting U.S. attorney from January until Town’s U.S. Senate confirmation as U.S. attorney in August. Posey served as first assistant U.S. attorney to former U.S. Attorney Joyce White Vance from July 2013 until assuming the acting U.S. attorney role when Vance retired. Posey has more than 25 years’ experience as a federal prosecutor in the Northern District, including serving as deputy chief of the Criminal Division, where he supervised white-collar crime, public corruption and civil rights cases.

In his role as executive assistant U.S. attorney, Posey will be tasked with a number of leadership and managerial roles, to include direct supervision of the Administrative Division, supervising special projects and working groups, and continuing as the district office security manager.

As an assistant U.S. attorney, Posey received the Justice Department’s highest award presented to an attorney for trial of litigation for his role in the successful prosecution of the 16th Street Baptist Church bombing cases. He received a similar Justice Department award for his role in the environmental crime prosecution of McWane Corporation.

Before joining the U.S. Attorney’s Office, Posey served 10 years as a state prosecutor in Jefferson and Shelby counties. He is an Alabama native and a graduate of Washington and Lee University in Lexington, Va., and the Cumberland School of Law of Samford University in Birmingham. He also is a retired U.S. Army Reserve

BIRMINGHAM – U.S. Attorney Jay E. Town has named Lloyd Peeples as first assistant U.S. attorney for the Northern District of Alabama, the office’s number two post. Peeples began work in the leadership position this week.
“Lloyd Peeples brings tremendous energy, devotion, and skill to the Northern District,” Town said. “His experience, coupled with his leadership capability, will serve the entire office well. I am very proud that Lloyd Peeples joins us as my first assistant U.S. attorney.”

As the first assistant U.S. Attorney, Peeples will supervise the Criminal, Civil, Appellate and Administrative Divisions. The first assistant U.S. attorney regularly receives case briefings, serves as a liaison with state and federal agencies, represents the U.S. Attorney’s Office to the public, and handles administrative matters as directed by the U.S. attorney.

Peeples worked as a prosecutor in the Northern District of Alabama from 2003 until 2012, handling a variety of civil and criminal matters, including civil and criminal health care fraud, False Claims Act, tax fraud, mortgage fraud, bank fraud, and public corruption cases. Peeples left the U.S. Attorney’s Office to assist in managing his father’s manufacturing business. Following his father’s death, Peeples took over as chairman of the board and chief executive officer until the family sold the company in January 2017.

Peeples was born in Dothan. He attended Washington and Lee University, where he received his bachelor’s degree in 1995. Peeples obtained his law degree from Samford University’s Cumberland School of Law in 1998. Peeples worked as a judicial clerk and in private practice in Birmingham before joining the U.S. Attorney’s Office for the Northern District of Alabama as an assistant U.S. attorney in 2003.

Peeples said he is grateful for the opportunity to re-join the U.S. Attorney’s Office and return to public service.

BIRMINGHAM – The U.S. Attorney’s Office for the Northern District of Alabama today charged a licensed Alabama deer breeder and his associate for illegally transporting captive-bred and raised whitetail deer from a facility in Indiana to his deer breeder facility in Alabama. U.S. Attorney Jay E. Town and Alabama’s Wildlife and Freshwater Fisheries Division Chief of Enforcement Michael Weathers announced the charge.
Prosecutors filed a one-count information charging LEWIS H. SKINNER, 56, and his associate FRANKLIN BANKS LODEN, 56, both of Northport, with knowingly transporting and receiving whitetail deer in interstate commerce. The defendants should have known that the wildlife was possessed and transported in violation of the laws and regulations of the State of Alabama and the federal Lacey Act, according to the charge.

In conjunction with the information, prosecutors also filed a plea agreement with Skinner and Loden in the U.S. District Court. According to the plea agreement, Skinner owned and controlled all activities occurring on Skinner Farms, a private deer breeding business in Sumter County, Ala. Skinner had obtained a deer breeder permit from the State of Alabama and knew that Alabama is a “closed border” state that prohibits importing deer.

According to the plea agreement, Skinner surrendered his Alabama Game Breeders License and agreed not to participate in the commercial deer breeder industry in the future. Skinner also agreed to pay a $100,000 fine, which shall be directed to the Lacey Act Reward Fund, and $650,000 in restitution to the State of Alabama.

In November 2016, according to the plea agreement, Skinner arranged for Loden to move six captive-bred whitetail deer covertly from Indiana to Skinner Farms in Alabama. Law enforcement stopped Loden and seized the deer in Tuscaloosa, Ala. Investigators determined that some of these illegally transported deer were lacking the required identification for the Chronic Wasting Disease Herd Certification Program. The deer in question, fawns from a previously certified herd, rendered the farm and other deer disqualified from the program because of the lack of identification. The required identification is usually in the form of a numbered ear tag or tattoo.

CWD affects the central nervous system of deer species, including whitetail deer. The disease attacks the brain of an infected animal causing it to become emaciated, display abnormal behavior, lose bodily functions, and die. CWD is infectious, communicable and 100 percent fatal.

“The illegal transport of deer from outside the State of Alabama by a licensed deer breeder motivated solely by profit places our entire whitetail deer herd at risk of this fatal disease,” Weathers said. “The charge and plea agreement in this case are evidence of the Wildlife and Freshwater Fisheries Division’s steadfast dedication to protecting the wildlife resources of the State of Alabama,” he said.

As noted in the plea agreement, Skinner is submitting all captive whitetail deer held in his deer breeder facility to be tested for the presence of CWD.

The Alabama Department of Conservation and Natural Resource’s Wildlife and Freshwater Fisheries Division investigated the case in cooperation with the U.S. Fish and Wildlife Service Office of Law Enforcement. Assistant U.S. Attorney Henry Cornelius is prosecuting the case.

STATE AG ANNOUNCES MULTIPLE LAWSUITS TO ENFORCE STATE LAW BANNING ILLEGAL GAMBLING

MONTGOMERY—Attorney General Steve Marshall announced recently the filing of multiple lawsuits against casinos in five counties that continue to operate illegal slot machines, as so-called “electronic bingo,” in defiance of state law.  The lawsuits call upon local circuit courts to prohibit the defendants from promoting, operating and transporting so-called “electronic bingo” machines and slot machines in those counties. The State also filed motions requesting that the circuit courts grant preliminary injunctions to cease unlawful gambling operations in these counties while the lawsuits are pending. 

The civil lawsuits were filed in Greene, Houston, Lowndes, Macon and Morgan counties against the operating casinos, machine manufacturers and vendors, and the governmental authorities responsible for licensing and overseeing electronic bingo operations in those counties.

“It is the responsibility of the Attorney General to ensure that Alabama’s laws are enforced, including those laws that prohibit illegal gambling,” said Attorney General Steve Marshall.  “Through multiple rulings in recent years, the Alabama Supreme Court has made it abundantly clear that electronic bingo and the use of slot machines are illegal in all Alabama counties.  Therefore, we have taken action to hold accountable those who defy the laws of our state.  These lawsuits represent a comprehensive legal approach developed by the Attorney General, with the assistance of the Office’s career experts, to finally put a stop to illegal gambling.”

Since assuming office in February, Attorney General Marshall has continued to assist other agencies and district attorneys in the enforcement of anti-gambling laws in Alabama.  The multi-county lawsuits filed today are the culmination of ongoing investigations into these casinos and gambling ventures around the state.   The civil complaints call for the closure of the casinos because the illegal gambling they offer presents legal nuisances in the state.

The State has pursued numerous cases over the past five years to bring clarity and enforcement to the anti-gambling laws of the state.  In each of these cases, the courts of the state have repeatedly determined that the game of bingo cannot be played on electronic devices, and slot machines are clearly illegal in the state.

The most significant cases include the following:

  • State v. Anchor Club, et al., CV-2011-900213 (Jefferson Co. Circuit Court) – the trial court granted summary judgment in favor of the State because the devices were illegal slot machines
  • State v. Southern Star, CV-2012-900053(Lowndes Co. Circuit Court, 2013) – the trial court granted summary judgment in favor of the State as machines cannot play the game of bingo in Lowndes County
  • Ex parte State, 121 So. 3d 337 (Ala. 2013) – the Supreme Court ordered that the Macon County Circuit Court issue a search warrant for illegal gambling devices at VictoryLand because the machines did not appear to play bingo and were slot machines
  • State v. Greenetrack, Inc., 154 So. 3d 940 (Ala. 2014) – the Supreme Court ruled that games of bingo in Greene County must meet all Cornerstone requirements and a machine cannot play the entire game, ordered the trial court to issue a search warrant for gambling machines in Greene County
  • HEDA v. State, 168 So. 3d 4 (Ala. 2014) – the Supreme Court upheld the Houston County Circuit Court’s determination that machines do not play the game of bingo
  • State v. $223,405.86 et al., 203 So. 3d 816 (Ala. 2016) – the Supreme Court found that bingo cannot be played on machines in Macon County, contrary to the trial court’s ruling and ordered the condemnation of all seized devices and money from at VictoryLand
  • State v. $191,249.11 et al., CV-2014-900041 (Greene Co. Circuit Court, 2016) – the trial court held that the sized devices, records and currency from Frontier Bingo in Greene County were condemned and forfeited as illegal gambling devices
  • State v. Choctaw Entertainment Center, et al., CV-2013-903288 (Mobile Co. Circuit Court, 2017) – the trial court held that bingo could not be played on electronic devices in Mobile County
  • State v. 825 Electronic Gambling devices, et al., — So. 3d —- (Ala. 2016) – The Supreme Court held that machines could not be used to play bingo in Greene County and overturned the trial court’s erroneous ruling
  • State v. $1,077.00 et al., CV-2016-903396 (Jefferson Co. Circuit Court, 2017) – the trial court found that the games played at Bid City in Jefferson County were illegal slot machines and condemned them
